A New York Judge Supports Vaping In A Big Way

Electronic cigarette versus dirty smelly normal cigarette buttsAfter quite some time facing the critics and numerous people who are against vaping, a New York judge finally rules in favor of electronic cigarettes. While vaping on a New York subway platform, a man was cited for using his e-cigarette in public. Not taking this lightly, the man challenged the citation claiming that vaping is not the same thing as smoking. In this case, “People vs. Thomas,” the judge agreed with the cited man.

 

The judge sided with the individual cited for vaping because of what the New York anti smoking law states. It states that smoking is, “the burning of a lighted cigar, cigarette, pipe, or any other matter or substance which contains tobacco.” The court decided that overall the act of using a vaporizer is not the same thing as smoking. They even stated that, “An electronic cigarette neither burns nor contains tobacco.”

 

This is a great step for the world of vaping. This judge did a great job at looking at the actual facts surrounding electronic cigarettes. There will most likely be a scramble to change the wording of laws to not have this oversight happen again but for now, the vaping world celebrates the little victories.
